About the talk:
Preventive detention has become a part of the legal fabric in India, and, as recent developments testify, a political weapon as well. In this context, I will offer some perspectives on Article 22: part of India’s Constitutional text which permits this form of arrest and detention without trial. By the end of our conversation, I hope to convince you that the preventive detention clauses of Article 22 must go, if India wishes to uphold the serious commitment to personal liberty that the Constitution envisaged.
