Abstract: The Act came into force on April 18, 2022. It seeks to authorise collection, analysis and storage of biometric and personal data of any person arrested by executive authorities including convicts. The powers of state and its enforcement agencies are significantly enhanced with regard to the taking of biometric and other biological data of any person arrested by the police, (including persons detained under preventive detention laws). The act of refusal to give any such data is made an offence. In these terms, the Act has completely transformed the established process of criminal investigation. While on the one hand, the law is being seen as a significant development in the criminal justice administration, especially the processes of identification and investigation in criminal matters. On the other, it has generated intense debate on questions of fair trial, privacy, individual autonomy, right against self-incrimination, amongst others. The talk will reflect on these concerns while bringing emphasis on philosophical underpinnings of the criminal law jurisprudence and the mandate of constitutional guarantees which form the foundations of criminal justice in India.
About the speaker: Usha Ramanathan is an eminent legal scholar and an internationally recognized expert on law and poverty. Her work on biometric identification and the interface of law with technology is globally acknowledged. She studied law at Madras University, the University of Nagpur and Delhi University. She is a frequent adviser to non-governmental organisations and international organizations.
